1. About Brainer
Brainer ("Brainer", "we", "us") is an online study platform for university, TVET and college students in Kenya. It brings together past exam papers, an AI tutor grounded in those papers, personal notes, and a student community. These Terms govern your use of Brainer and any subscription you purchase. By creating an account or buying a subscription, you agree to them.
2. Accounts
- You register with a valid email address and are responsible for keeping your login credentials secure.
- One account per student. Sharing an account, selling access to it, or automating access is not permitted.
- You must provide accurate information. We may suspend accounts used for abuse, fraud, or circumventing payment and usage limits.
3. Subscription plans
Brainer offers three paid subscription tiers. There is no free tier.
- Starter — KES 19/month. Up to 5 past papers per subscription period (maximum one paper per subject), 10 AI tutor questions per day, community and personal notes. No PDF downloads.
- Premium — KES 199/month. Full past-paper library, 50 AI tutor questions per day, community and personal notes. No PDF downloads.
- Premium+ — KES 399/month. Everything in Premium, 200 AI tutor questions per day, and PDF downloads.
Prices are in Kenyan Shillings and include applicable taxes unless stated otherwise. Paper counts and daily AI limits are enforced server-side and reset as described in section 4.
4. The 30-day subscription period
A subscription on Brainer is a prepaid 30-day access period — not a rolling monthly contract:
- One successful payment activates your chosen plan for 30 consecutive days, starting the moment the payment is verified.
- Your 5-paper Starter allowance (where applicable) resets when your own 30-day period renews — not at the start of a calendar month. A subscription bought on the 15th runs to the 14th of the following month.
- If you pay again before your current period ends, the new 30 days are added on top of your existing expiry date. You never lose days you have already paid for. For example: if your plan expires on 1 September and you pay on 25 August, your new expiry is 1 October.
- If you pay after your period has already expired, the new 30 days start from the moment of that payment.
5. No automatic renewal
Brainer subscriptions do not renew automatically. We never charge you without you explicitly starting a payment. When your 30-day period is ending, you choose whether to pay for another period. Nothing to opt out of, no recurring charges to remember.
6. Cancellation
Because subscriptions do not auto-renew, there is no separate cancellation step:
- To stop using Brainer on a paid basis, simply do not make another payment when your current period ends.
- Your plan remains fully active until the end of the 30-day period you have paid for. We do not end it early or reduce what you can access mid-period (except where section 9 applies).
- If you want your account and personal data deleted entirely, contact us at the address below (see also the Privacy Policy).
7. Payments
- Payments are processed by a third-party payment provider. Brainer never sees or stores your card number, M-PESA PIN, or other payment credentials.
- A subscription is activated only after the payment is verified server-side by Brainer. A payment is normally confirmed within seconds; in rare cases confirmation may take a few minutes longer.
- If a payment you made is not reflected in your account, sign out and back in, or reopen the Subscription page — Brainer re-checks the payment status automatically. If it is still missing after 30 minutes, contact support with the transaction reference from your M-PESA or card statement.
8. Failed payments
If a payment fails, is cancelled, or is abandoned before completion, no charge is made and no subscription period starts — you only pay for periods that are actually activated. You can retry the payment at any time. A failed payment never leaves you with a debt to Brainer.
9. What happens when a subscription expires
- Paid features stop: viewing paper content, AI tutor usage, and (on Premium+) downloads require an active plan.
- You keep browsing paper details and metadata, so you always know what is available when you return.
- Nothing is deleted. Your account, personal notes, bookmarks, community activity, and payment history are all retained and restored in full when you subscribe again.
- We do not delete student accounts or study data merely because a subscription expires.
10. Plan changes
- Upgrades (for example Starter to Premium) take effect as soon as the new payment is verified. The new plan replaces the old one for the new 30-day period.
- Moving to a cheaper plan simply means your current paid benefits run until the end of the period you already paid for, and the cheaper plan applies from your next payment.
11. Refunds
- Because access is granted immediately on payment and consumed during use, subscriptions are generally non-refundable once activated.
- If a verified technical failure on our side prevented you from accessing what you paid for, contact support within 48 hours of the payment. If we cannot resolve the issue, we will refund the affected payment in full.
- Approved refunds are processed through the payment provider to the original payment method. Refund processing times depend on that provider and your bank or mobile-money operator.
- When a payment is refunded or reversed, the subscription it paid for is revoked — access ends at that point. Any data you created remains yours.
12. Acceptable use
You agree not to:
- Redistribute, resell, scrape, or bulk-download content from Brainer.
- Attempt to bypass payment, usage limits, or access controls, or access another student's data.
- Use the AI tutor or the platform for any unlawful purpose, or upload content you do not have the right to upload.
- Interfere with the service's operation or other students' use of it.
Past papers are provided for personal study and exam preparation. You remain responsible for how you use them under your institution's rules.
13. AI-generated answers
The AI tutor answers are generated from the content of the paper you select. They can be wrong or incomplete. Treat them as a study aid, not an authority — always cross-check against your course materials and lecturer guidance.
14. Availability and changes
We work to keep Brainer available, but the service is provided "as is" without warranties of uninterrupted availability. We may add, change, or remove features over time. If we change these Terms, the updated version is posted on this page with a new "Last updated" date; material changes that affect active subscriptions will be communicated in the product before they take effect. Continuing to use Brainer after changes are posted means you accept the updated Terms.
15. Suspension and termination
We may suspend or terminate accounts that breach these Terms — including fraud, payment abuse, account sharing, or attempts to circumvent access controls. We will tell you why where practical. You may stop using Brainer at any time; sections that should survive (payments made, refunds, data protection) continue to apply.
16. Governing law
These Terms are governed by the laws of Kenya. Disputes will first be addressed by contacting us directly so we can resolve them quickly.
17. Your institution's rules
Brainer is a study aid. How you use past papers and AI assistance remains subject to your institution's academic rules — respect them.
